Filing an Appeal for a Denied Medicaid Application

When a New York City Medicaid applicant receives a notice of denial for coverage, he or she may request a fair hearing. This is a hearing held in the presence of an administrative law judge for the Office of Temporary and Disability Assistance. The judge will hear arguments on the applicant's behalf or by a representative of the applicant who received a notice of denial. A fair hearing is held to determine whether the denial or discontinuing of coverage was correct. Within 90 days or possibly less, the final decision by the OTDA will be made and a formal written response sent to the applicant.
